Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the CarePulse mobile application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

CarePulse is a care coordination tool that helps families track check-ins for loved ones. The Service allows users to create care teams, log check-ins, receive alerts, and manage notification preferences. CarePulse is not a medical device, emergency service, or healthcare provider.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

4. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate information and to update it as necessary.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service
  • Upload malicious content or attempt to reverse-engineer the application
  • Use the Service to store or transmit protected health information (PHI) that requires HIPAA compliance

6. Care Teams & Shared Data

When you create or join a care team, other team members can view check-in records, loved one names, and team membership. You are responsible for ensuring that you have appropriate consent before adding information about loved ones to the Service.

Team owners can remove members and delete loved ones. If a team owner deletes their account, ownership is transferred to the next eligible member. If no other members exist, the team and its data are permanently deleted.

7. Subscriptions & Payments

CarePulse offers a free tier and a paid subscription ("CarePulse Circle"). Subscriptions are billed through Apple's App Store or Google Play and are subject to their respective terms and refund policies.

  • Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
  • You can manage or cancel your subscription in your device's app store settings
  • Subscription benefits apply to the entire care team, not just the purchasing user
  • Refunds are handled by Apple or Google per their policies

8. Not a Medical Service

CarePulse is not a substitute for professional medical care, monitoring, or emergency services.

The Service provides check-in tracking and notifications as a convenience for family coordination. It does not monitor vital signs, detect medical emergencies, or provide medical advice. Alert tiers (yellow, orange, red) reflect elapsed time since the last check-in only — they do not indicate a medical condition.

If you believe someone is experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on CarePulse for emergency situations.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. Push notifications depend on third-party services (Apple Push Notification Service, Firebase Cloud Messaging) and device settings that are outside our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREPULSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

11. Account Deletion

You may delete your account at any time from the Settings screen within the app. Account deletion is permanent and will remove your profile, team memberships, and all associated data. If you are the sole owner of a care team with other members, ownership will be transferred before your data is deleted.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users or the Service. We will make reasonable efforts to notify you before termination.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or via email. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of the state in which CarePulse operates.
